Alabama Abandoned Vehicle Overview

Alabama's abandoned vehicle laws are governed by Code of Alabama § 32-13-1 et seq. Alabama uses the standard 72-hour street threshold and 30-day private property notice period. Title claims go through the Alabama Department of Revenue (DOR) Motor Vehicle Division. Alabama county sheriffs play a significant role in rural abandoned vehicle enforcement — the state's unincorporated areas are extensive.

Street Time Limit

Report abandoned vehicles on Alabama public roads to your local police non-emergency or county sheriff. Alabama Law Enforcement Agency (ALEA) handles state highway cases at (334) 242-4371. City police handle incorporated areas; county sheriffs handle unincorporated areas. Officers post notice and attempt owner notification through Alabama DOR records. Birmingham, Huntsville, and Montgomery all have 311 or online reporting systems.

Private Property Removal

Document vehicle, file police or sheriff report, wait 30 days after certified notification, arrange removal through a licensed Alabama tow company. Birmingham: (205) 254-1764 · huntsville.gov/303 for Huntsville · Montgomery: (334) 241-2651. Always keep your police report number and certified mail receipts — required for title claim.

Claiming Title

Alabama title claims go through the DOR Motor Vehicle Division. Steps: (1) File police/sheriff report. (2) Request owner info from Alabama DOR at (334) 242-9000 or revenue.alabama.gov. (3) Send certified notice. (4) Wait 30 days. (5) Apply through your county probate judge's office (Alabama titles go through county probate judges, not a central DMV). Processing 4–6 weeks.

Inoperable Vehicle Storage

Alabama does not have a statewide inoperable vehicle storage rule. Most Alabama cities prohibit inoperable vehicles visible from public streets. Birmingham Code Chapter 7 addresses this. Rural Alabama counties are generally more permissive. Check your city's code or county ordinance.

Frequently Asked Questions

Alabama's vehicle registration and title system is administered at the county level through elected probate judges (also called judges of probate or county license commissioners depending on the county). This is a legacy of Alabama's county-based government structure. To apply for an abandoned vehicle title in Alabama, you ultimately submit your documentation to your county's probate judge office, not to a state DMV office. The DOR oversees the system statewide, but title issuance happens at the county level. Find your county probate judge at revenue.alabama.gov/motorvehicle.

Alabama does not have an equivalent to Michigan's HB 4122 expedited track for hazardous junked vehicles. The standard 30-day process applies regardless of the vehicle's condition. However, if the vehicle presents an immediate environmental hazard (active fluid leaks, fire risk), contact your local code enforcement division in addition to filing a police report — code enforcement may have independent authority to act faster under local nuisance ordinances.
